The Problem!

As always I do my best to keep you informed and to deliver unbiased opinions of what is going on in the business that we are involved in.

As most, if not all of you may or may not know by now that, on 6th of August the US Attorneys Office brought a Civil Action against ASD and Andy Bowdoin and a few others within the company and froze the company’s bank accounts.

This has in effect frozen all members’ money.

It has yet to be proven that ASD and Andy Bowdoin have done anything illegal.

The Civil Action has been instigated by a small number of complaints from certain parties.

It is unfortunate that we live in a world where there are people, that when money is concerned will do, and say anything to disrupt a program that is extremely successful and, has made a positive difference to so many people’s lives.

You will know yourself that there are literally hundreds if not thousands of blatantly corrupt programs on the net that deserve to, and should be closed down.

There are also the traditional home based businesses that have a problem with the competition that ASD has provided. The one problem that I can see is; How can they compete with a program where 100% of the people make money, regardless of whether they recruit others or not.
With the traditional home based businesses, 98%+ people that get involved spend more money than they make, and fail.

It is not so long ago that Franchising was frowned upon and came close to being banned and made illegal. And yet, today it is a respectable and accepted form of business?

Andy Bowdoin created a win-win program for ASD members that grew very quickly and members were getting paid right up to the day the, Attorney General interfered and sent in the Secret Service.

I may be a little out of step here, but considering the state of world affairs, I would have thought that the American Secret Service and their covert operations would have more pressing and urgent matters to investigate, than to investigate an alleged Ponzi? And it is only, an alleged Ponzi?

Unfortunately for Andy Bowdoin, ASD and its members, the program was a victim of its own success and easy prey, everything was up front on the web site.

I am of the opinion that there is a hidden agenda here somewhere which is entirely different and far removed from what is being portrayed and spun in the media.

Members of ASD are being depicted in the press and in press releases by various USAGOs throughout the USA as being victims of a Ponzi. I as a member of ASD do feel that I am, “victim,” of any wrong doing by Andy Bowdoin. But, I do feel that I am being victimised by the legal action taken by the, Attorney Generals Office, that has seriously curtailed my income.

It has been said that ASD funds were being moved “Off Shore,” If this is correct, then I can fully understand that in the present USA economic situations, why the powers that be, would not like this out flow of cash.
However if this is correct, I applaud ASD for trying to protect its members money from a, Smash and Grab,” by the US Government.

If ASD was an Off Shore company then ASD would not have to provide US citizens with, 1099s US Government Tax return forms?

Andy Bowdoin, ASD and its members are not taking the US Attorneys action laying down, they are fighting back.
The firm of attorneys in Miami, headed by a former US Attorney General defending ASD, has confirmed that in his opinion and the opinion of the lawyers that work with in the firm that ASD is NOT a Ponzi.

I can understand if you are thinking that a lawyer would say such a thing about his client. But this is a civil action, and unlike criminal actions where the defence lawyer gets paid by the state. Civil action Lawyers only get paid if they win the action. So, if the Miami Lawyers did not think that they were on to a winner, I doubt if they would take the case.

I have also heard from my sponsor that ASD is also being represented by the top MLM lawyer, who has represented clients like Amway.

As I explained earlier this is a civil action and ASD Members are also fighting back and are being represented by Larry Friedman of Friedman & Feiger (http://www.fflawoffice.com/).

It is not going to be cheap, but neither is losing your money because of the actions of the US Attorneys Office.

However before you commit yourself to donating money to the fighting fund, I would also like to put forward a down side to this.

About Andy Bowdoin
Andy Bowdoin has not been completely honest with regards to his background as a successful entrepreneur although ASD has been very successful.

I also find it disconcerting that the ASD attorney Robert Garner stated on camera that he and his team verified that ASD was a genuine business and NOT a Ponzi.
Although Robert Garner is a qualified lawyer it appears he does not have a team working with him and that he works from home.
I do not have a problem with Robert Garner working from home, I work from home and make a very good living and I am good at my job. It is one of the reasons that I signed up with ASD. This video presentation and the way it was presented led me to believe that Robert Garner was a big time operator with a team of attorneys behind him.
However this does not mean that Robert Garner was, and is not qualified or competent enough to state that in his opinion ASD was and is, a genuine business model and, not a Ponzi.

I also have a problem with people misrepresenting their past, which calls in to question Andy Bowdoin’s’ integrity. We have all done things in the past that we are not proud of, or wish we had not done, how often have you wished you could turn the clock back?
I expect that Bill Clinton (the last democratically elected President of the United Sates) can verify that it was not his escapades that caused him the most harm; it was the deceit of trying to avoid telling the truth that called his integrity into question with the public.

What you have done in the past is in the past and will always be there waiting to bite you when you least want it to.

I think that Andy Bowdoin came up with a very good idea and business model and maybe somewhere in the back of his mind he realised that if his past was known, his project may fail because of it. Perhaps it would have, but it didn’t, Andy Bowdoin created a business that is and was, until the intervention of the US Attorney Generals Office a successful business model that was making money for every one of its members.

Regardless of my thoughts of Andy Bowdoin, I still support ASD and I will continue to do so. It is an innovative idea that has changed for the better the lives of a lot of people.

I would also like to point out at this time that is the prosecutions job to paint the blackest picture that they can.

New innovative ideas are not always welcomed with open arms and have been treated with scepticism and cynicism, with the old adage, “if it sounds too good to be true, then it must be”? But, this time the ASD business model bucked this trend, ASD is a great idea, but since 100% of its members were making money, then the thoughts are, that there must be something wrong with it.

The one thing that you have to remember at this point is that, the media deal in sensationalism, sensationalism sells news papers which builds up readership that brings in revenue and the prosecution will paint the blackest picture of events, without any commentary with regard to facts, circumstances or, perceived wrong doings.
The blacker the picture the prosecution can paint against ASD will be picked up by the media and sensationalised.

None of us want to see programs that we contribute to go down the tubes. But those of us that have been in the business for some years know this happens. We also know that the majority of programs out there are either, blatantly fraudulent, mismanaged or a Ponzi from the start. What I find exceptionally galling is a successful program that is making money for 100% of its membership being closed down by the government for being too successful.

Legal fund set up:
As I expressed earlier on this page, ASD membership is not represented by the ASD legal team fighting the court action.

ASD members need an attorney with a successful record who is capable of communicating our position as members. If Plan A does not work (ASD Lose) then Plan B is put into action. We do not want the money that belongs to ASD and ASD members being confiscated by the government.

A Legal fund has been set up to pay the legal expenses of the lawyer Larry Friedman of Friedman & Feiger (http://www.fflawoffice.com) representing ASD members.

I support this fund as I think that it is very important that the Attorney Generals Office is not allowed to ride, rough shod, over ASD members. We have the right to have our voice and opinions heard and defend our business and incomes.

It is now down to Andy Bowdoin and the ASD legal representatives to prepare and present their rebuttals to the accusation of the Attorney General. And submit details of the business model and convince the regulators that the business is viable, sustainable and legally compliant.

I realise that this is not going to be of great comfort to you but:
If there are some of you that feel that you have not done the right thing by your team or others that you have signed up, you may be able to take some comfort from the fact that there are more educated, informed and some brilliant legal minds that indicate that we were not wrong in thinking that we were doing, the right thing.
